How to get a divorce in Italy for Italian citizens-two States?
I am a U.S. citizen, married to my husband, who is an Italian-American double. We got married (I like American, he and Italian) in Italy, but never filed the marriage in the U.S.. We are now discussing the possibility of a divorce. Considering that takes 3 years of separation to get a divorce in Italy, one can accept a divorce U.S. in Italy? In other words, we must continue the law ministers of Italy or the USA? For details, currently residing in Japan, while my husband lives in the U.S..
This does not matter if you and your husband presented or not your marriage in the U.S.. You can still get a divorce in a U.S. court of law, and that the decision recorded in Italy through a process of so-called "di sentenza delibazione, or simply to have it entered in the Civil Registry of the Italian city where the marriage was originally registered. This last option, which is time faster and consumes less, can only be taken if the judge states U.S. that its decision conforms to international conventions relating to the Hague Conference on Law, of which Italy and the U.S. are signatories. Once you get the sentence would have to translate it into Italian and sent to Italian Consulate of reference, which in turn will get registered in Italy ..
